    According to DAR verification of applications, there is no basis to believe that Mourning HOSKINS was the wife of Roger Cock Bailey. Neither is there reason to believe that Miss Pettis was the first wife. At any rate, the first wife died in Henrico Co, VA before the family moved on to Charlotte Co. She could have been a Yancey.

    Dorman lists both of his spouses as uncertain.

    Dorman records the first six children in Adventurers and not the rest. He says that these six are all through Roger's first wife. He doesn't make any claim as to who either wife is.

    Realistically, I need to reconstruct all of his residince and history since I don't believe his pension affidavit.

    Peter Bailey died in KY. He lived for some time in Montgomery Co, TN and then across the border into Kentucky with a daughter near present day Ft. Campbell.

    In the 1820 Mecklenburg census, Peter Bailey is listed as Capt Peter Bailey and has 59 slaves, a very wealthy man. It went south not long after that.

    In his pension deposition, Peter says that his father marched with the army to the south, leaving him at home with his stepmother. Shortly after that, he left for the war, himself. After the Battle of Eutaw Spring, he returned home and remained in Mecklenburg until the winter of 1831, when he moved to Montgomery County, Tennessee.

    Peter also states that William and Abraham Bailey were some of the earliest settlers on the James River near Richmond, and Abraham was his grandfather. Abraham died in Henrico and left 3 slaves to Peter who were taken by the British without payment.

    After the battle of Eutaw Springs, he headed home with John Pemmerton, Shadrick Whit, Mical Willow, William Scandling, John Lockling, John Consolver. Reentered the service and ultimately was elected Captain.

    In his first deposition, he lays out his service time and ends with Eutaw Springs. The pension appears to be denied and he applies again, this time with a much more flowery depiction of his service, where he is raised to captain of his company by acclamation. However, at this point, Henry Brame makes a deposition that he has known Peter since they were in school together. He says he cannot possibly be old enough to have served and that in all the time he has known him, some 45 or 50 years, he had never mentioned serving. Sounds like he started to get a pension, then Brame wrote and then it ended. Then the pissy letters started going back and forth about him being taken off the roll.

    In the end, a number of people familiar with Peter wrote to the Commissioner of Pensions and pointed out that he was too young to have served, never claimed to have served, and on top of that had been a convict in the state penitentiary. The commissioner sent a later saying that these things needed to be investigated. And that was the last page of the file.

    In Mecklenburg County, while Peter was there, there were other Baileys that likely were connected one way or another but I have not yet figured this out. On the one hand, there is a Richard Bailey that shows up living relatively near to Peter. He may be Peter's brother Richard R. Bailey.

    There is a William Bailey nearby as well. Can't quite tell how he fits in.

    There are George, Howard, and others living in the other district of Meckenburg County. Still might be connected, but farther back.

    BIRTH: IGI reports his birth as 9 Oct 1762. Dorman reports it as 9 Oct 1765. However, his pension application claims 1762. However, he does not appear to be completely trustworthy in his application.

    In his deposition for his pension, Peter says he entered service in 1778 or 1779 in Granville County, North Carolina under Capt. William Taylor.

    Marched from Granville Court House to Hillsborough to Salisbury. Met up with Lock and marched to Camden and then toward Charleston. Marched to the Savannah River and then marched up and down the river. Eventually was discharged at a ferry called the Two Sisters after six months.

    Second service under Capt William Gill and Col. Parley of Granville. Marched up and down the river again and was discharged at the Two Sisters after five months.

    Third service, under Capt William Gill and Col. Thomas Yancey. Discharged after three months.

    Entered service again. Met with the troops of General Gates after his defeat. Was opposite the troops of General Nash when they were "cut to pieces". Discharged in the Cheraw Hills after serving three months.

    Entered service again. Marched to Charleston and remained there for some time. Discharged after three months.

    Entered service again. Engaged the enemy 4 miles west of Guilford Court House. Was wounded but was able to continue on the march. Discharged after three months.

    Entered service again. Marched to Eutaw Springs in South Carolina and engaged the enemy. Took sick afterward and the army moved on, so he went home to Virginia.

    MILITARY: Peter served during the Revolutionary War in the Granville Co., North Carolina militia.

    However. In light of the whole pension file and the fact that after a time his pension appears to have been rescinded, I am inclined to believe that he did not actually serve. He indicates that his father served. That is worth investigating.

    Misc:
    If Peter's father was appointed guardian, then he must have inherited property from one of his grandparents independently of his parents. A Guardian was required when the child had property and interests that needed to be looked after and they were not of age to do so.

    If Francis Barnes is appointed guardian for Peter Cock Bailey, then that presumably means that Roger Cock Bailey has died and that Peter is less than 14. But, this doesn't really make sense.

    By this point, Peter has already been in the military and should be 16 at least. Maybe this is a secondary appointment and he really was selected. I think this original record needs to be investigated.

    However, if Peter had inherited property from one of his grandparents, then a guardian would have had to be appointed to protect his rights.

    This appears to be a way for Peter to shield his property from lawsuits.

    Sold the bulk of his land holdings to his son Otway of Rockingham Co, NC. Peter retains possession but Otway retains ownership.

    Peter sold 42 slaves to Otway Bailey, his son, but retained possession. 42 slaves. Plus an additional 20 that were sold to William B Price.

    Peter had previously sold a lot of his stock to his son and son-in-law, for which they still owed him money. He also owed a lot of people money, including Nathaniel Maclin (whom I think had prevailed over him in court for payment).

    So, by this deed, Peter allows his sons to give him the stock that they bought back to him to satisfy their debts. Then, Peter will sell it and his personal property to satisfy Nathaniel Maclin's debt as well as other debts.

    This is a long and complicated deed with a number of parties. Peter sells multiple tracts of land, acquired from multiple parties, to satisfy debts due from suits in Superior Court to Bruce & Sydnor.

The judge was not moved and upheld the sentence and added that 1/12 of his sentence should be spent in solitary confinement.

Peter said that Grief had agreed to represent him in a recent criminal case (apparently the forgery incident) for $200 but then charged him $300. Green appeared in court of his on accord and released Peter of $100 of his debt and the movement was overruled.

    After much delay, the second case that Peter Bailey brought against Abraham Keene went to trial. The jury found for the plaintiff and assessed damages of $1406 plus interest and costs

    I have gone back and forth as to whether this is Peter C or Peter A Bailey. Based on the fact that there is a male 40-50 in the house, I believe it to be Peter C. That age is actually low for Peter C. He should be in the 50-60 bucket (like the WF enumerated), or even 60-70 if his Revolutionary Pension deposition is to be believed.

    It seems important to figure out who the free black male is. Some slaves were listed with surnames. Perhaps this is significant.

    On 22 Feb 1830, Peter Bailey entered into a deed of trust, really more of an appearance bond, to make sure that he showed up at the March court to answer a "Charge of Felony". The deed does not specify the charge, only that he must appear. The cash value of the bond is $250, but he is forced to put up a lot of property. William Bailey, his son / brother (depending on which Peter this is) also puts up a mare and colt as security.

    In this case, Jordan Stone is Peter's security, guaranteeing his appearance. William Townes can command the sale of the property if he does not appear. Many of the Baileys, Hills, and Marshalls had land transactions, selling to William Townes.

    Possessions:
    In this deed of trust, Peter Bailey essentially devises all of his property, just two weeks previously set up as collateral for a bond, to his heirs, with his sons Peter A and William H Bailey as the trustees.

    In this, he distributes land, personal property, stock, and slaves to his children, giving his wife Sarah a lifetime use of all of it.

    In this deed, Peter sells to his sons Francis B, William H, and Peter A not only his two large tracts of land (one to William and the other to Francis & Peter), but also all of his debts. In turn, the sale is only for $15. Peter must expect that they will have to sell the land to satisfy the debts but wants it out of his hands for whatever reason.

    Peter Bailey is brought before the court and accused of passing counterfeit currency. Then, he is charged with obstructing a witness coming to trial to deliver evidence against him.

    This is the second suit against Abraham Keene. Since he does not appear, default judgment is awarded to the plft.

    Possessions:
    Having lost a suit in Chancery Court, Peter Bailey was forced to sell a plot of land to satisfy the defendants.

    This suit, brought at the March 1831 court, between Humberton Shipwith, administrator of the estate of Jean Shipwith against not only the Baileys but their neighbors, led to the sale of Bailey's land and Lockett's land. 492 acres was sold at auction on 21 Apr 1831 from Peter Bailey to William Townes for $3.10/acre, a total of $1525.20

    A Second tract of land was forced to be sold by Peter Bailey as a part of the suit brought by Humberton Shipwith.

    This plot, making up 411 acres, was sold to Peter A. Bailey and William H. Bailey for $2.50/acre, a total of $1027.50.

    Possessions:
    As a consequence of losing a suit in Chancery Court, Peter Bailey was forced to sell a plot of land containing 411 acres. This happened on 21 Apr 1831. 411 acres were sold at $3/acre.

    Sellers were Peter Bailey and wife, Peter A Bailey, Francis B Bailey, and William H Bailey. Purchaser is Samuel Lockett.

    Possessions:
    As the consequence of a lawsuit in the March 1831 court against Peter Bailey, his children, and others, 411 acres of his land along Butcher's Creek (which sounds like his original land in the area) was sold by sheriff's commissioners.

    Peter A. Bailey and William H. Bailey purchased the land for $2.50 / acre, or a total of $1027.50.

    It appears that this case started with Peter, being the administrator in an estate, sold slaves that were not to be sold. The plaintiff claimed that they were part of the natural increase of the other slaves included in the bequest and not available for sale.

    Whether this long-running dispute led to Peter leaving the area is unknown. But it wasn't very long after this appears to be settled that he and Sarah moved away.

    Facing an indictment for counterfeiting, and significant loss for not appearing, Peter Bailey fails to appear for court

    Residence:
    Peter Bailey applied for a pension due to his service in the Revolutionary War. He was living in Montgomery County, Tennessee at this point, which is why he appointed John Winkler as his attorney for the court actions in Meckenburg. It appears that he may have moved there as early as 1831, when he failed to appear in court in Mecklenburg on charges of passing counterfeit money.

    According to his daughter, Peter Bailey was awarded a private pension from the US House of Representatives. There is a record that he petitioned to be restored to the pension roll during the 25th Congress (March 1837-March 1839) during its second session. This was referred to the committee on Revolutionary Pensions and is recorded as a Petition on Journal Page 271 for the 25th Congress, 2nd session.

    In a letter inquiring about her father's pension in 1889, Elizabeth M A Bailey Harralson says that her father was awarded a private pension in 1843 for his Revolutionary Service but he never received it, and now she would like what was due him.

    She also claims to have been well acquainted with President William Henry Harrison and his family.

    Died:
    Some sources put his death in Tennessee. Others in Kentucky. In any case, it appears that in his later years, he moved to be with some of his children.

    Notes:

    Francis Baker Bailey and his family were certainly in Arkansas by February 1837, since his son Charles G. was born in Arkansas. Could they have been in Arkansas prior to statehood in 1836?

    In a letter to F.B. Bailey, dated 1848, he is addressed as Cousin Baker and is living in Warsaw, Missouri.

    7 March 2006 - Today, I visited the Galley Rock Cemetery, the cemetery of the abandoned town of Galla Rock / Galley Rock. There are a number of stones standing and many more marked in the cemetery. It is located on Arkansas Highway 105, 7 or 8 miles south of Atkins, right on the highway, and well marked. Each grave that can be identified is marked with a modern marker from Lemley Funeral Services. They may be located in Atkins, Morrilton, or another close-by town and may have more burial records. According to a historical marker at the cemetery, Galla Rock, or Galley Rock as it also was known, was a trading post along to Arkansas River as early as 1819. By 1860, it had grown and was platted out as a town. However when the railroad came through in 1872 and bypassed the town, it began to fade as a trading port. Eventually, the town faded away and most of the remaining residents moved the 7 or 8 miles north to the town of Atkins. A Masonic lodge was established there but it also moved to Atkins.

    7 June 2007 - Last night, I visited with C. Tennyson Bailey at his home near Russellville, Ark. He lives very near to the old Rufus A. Bailey homeplace. We visited the Booher cemetery where Rufus and his wife, along with many of Tennyson's aunts and uncles are buried. We also visited the Bailey cemetery on the Bailey homeplace where Tennyson's parents, brothers, sisters, son, and other family are buried. Mr. Bailey says that F.B. Bailey moved around a lot. After leaving Virginia, he stayed in Montgomery County, Tennessee, in Kentucky just across the border (near present day Ft. Campbell) where a daughter lived, into Illinois, toward Memphis, and finally into Arkansas. Even in Arkansas, he lived near Batesville, in Crawford Co (when it included Pope), in Pope Co, and other places. In Pope Co, he ran an iron works at the town of Galla Rock (Galley Rock). He and Evalina are supposedly buried in the Galla City cemetery but most of the graves in this cemetery are unmarked at present. Tennyson said that there used to be a cast iron marker on one pair of graves that he had always presumed was F.B. and Evalina's grave since they had the iron works. But that marker has since been lost. Even when it was there, the name plate had long since been lost. Tennyson said that the Shinn family moved with the Bailey family from NC / VA into Arkansas and that they intermarried both in NC / VA and in Arkansas.

    MILITARY: F.B. Bailey served in the Virginia Militia during the War of 1812. He received a warrant for land as a result of that services.The land warrant number was 73339.

    "[F.B. Bailey] was a farmer by occupation, served as Justice of the Peace for many years, made a prospecting trip through Texas in 1845, afterward roamed through Arkansas and Missouri, and subsequently returned to Arkansas, where he died in January 1855."

He would not have appeared in the 1820 census, so he could be a child who died young.

    There is a Ward H Bailey and Jos (or Jas) H Bailey next door. They appear to be connected to FB Bailey, but I do not know how yet. Jos / Jas appears to be older since he has no poll. Also, it appears that FB has sold his land to his son in 1844.

    Familysearch reports that there exists (or existed) a Peter Bailey family Bible. In it, it says that Jane Bressie Bailey was born 3 Aug 1798 and died 2 Jun 1829, both in Mecklenburg. William B Price was born 1794 and I think I saw that he died in 1854.

    They had 3 children: Emily E Price, b. 20 Dec 1820, maybe in Christian County, Kentucky; William B Price, b. 24 Sep 1822, in Christian County, Kentucky; and Otway G Price, b. 28 Apr 1829 in Christian County, Kentucky.

    Thus far, I have not found any record of any of these folks after their marriage. I expect Jane died shortly after Otway was born. He may have died as well. Don't know about Emily. There are a lot of William Prices, so he may have survived.

    While there is a citation that William H Bailey died in 1835, I find a William H Bailey in the 1840 and 1841 Crawford County tax lists with fairly large land holdings.

    Additionally, I find marriage records in 1820 for William, indicating that he was born earlier than 1806.

    There is a William Bailey in the 1830 census, but he is in the other end of the county and none of the ages of the people in the family match up. There is also a page missing in the filming of the census right in the space where Peter C and William H would have been. Their neighbors are on the immediately preceding and following pages.

    I suspect that Elizabeth Mary Ann was young enough that she went with her parents when they moved out of Mecklenburg. Her marriage would likely be found elsewhere as a result.

    It may be that Elizabeth married Anderson Bailey Harralson of Hopkins County, Kentucky. I do not find that marriage in Hopkins County, though. Anderson B Harralson does appear on the 1835 tax list, however Peter Bailey does not.

    In the 1840 Hopkins County census, there is an entry for A.B. Harralson with 1 male 20-30, 1 male < 5, 1 male 70-80, 1 female 20-30, 1 female < 5. This makes sense. Supposedly, Anderson and Elizabeth married in 1834 in Montgomery County, Tennessee

    While this catalog says that it was published in 1845, at the end, it includes individual catalogs for several subsequent years, including 1845 when Giles P. Bailey graduated. At this point, he was living in Rockingham County, NC.

    In medical school, his graduation essay was on amenorrhea.

    In the 1880 census, Otway's children are living with Giles while Otway is away working. The girl is missing, possibly not having survived. There are a number of black servants in the house that appear to be listed in wills from Giles parents.

    It appears that after the Civil War, Otway and Laura married. She died, maybe in childbirth. He then married her sister Martha (Mattie), who also seems to have died before he moved back to NC. In North Carolina, his children went to live with relatives.

    It appears that Otway moved west with other extended family members. He married a woman whose mother appears to be related to his mother. There are a number of Bethell, Watt, and Stubblefield families in Dallas County, Arkansas apparently with roots in North Carolina.

    Four slaves are listed in the Northern Division of Rockingham county in households other than OL Bailey's, but he is noted as the owner. Looks like these people are contracted into the other households.
    In the home of David Osborn are a female age 25 and a female age 1.
    In the home of Samuel S Williams is a female age 11.

    This appears to be O.L. Bailey's home. Here, he is listed as owning 17 slaves, one of whom is a fugitive from the state.

    Interestingly in the population schedule, while Otway's neighbors before and after him in the slave schedule appear. But Otway does not appear among them in the population schedule.

    Military:
    9 Texas Field Battery, also known as Lamar's Artillery, was formerly known as Capt. Daniel's Co. Texas Artillery, and as Daniels Battery. A lot of these units were part of the "Trans Mississippi Infantry" and had names that spanned Arkansas and Texas.

    From this I might gather that O.L Bailey enlisted, was detached to a different organization, was discharged from that organization, and word might not have got back to his original unit.

    Census:
    In the 1870 census, Otway is listed with a wife, Laura, and three children, Pinck, Fannie, and Otway L. Additionally, in the household are a Daniel Harrison, age 21, and a Delilah Bailey, age 35, black, with her children. It looks like one child is listed as mulatto and one black. Since this is 1870, no relationship is provided. These could be a family that were previously slaves of the family. It would be worth checking the slave schedules.

    There are also several other Baileys living nearby. Check these against Otway Sr.'s will.

    Notes:

    Hume Bailey was a devoted Union sympathizer during the Civil War. Since he was a widower with young sons, he was exempted by the Union army from service (Ft. Smith being a Union stronghold in an otherwise Confederate state). However, the Confederate army, when it moved into that part of Arkansas forced him to enlist on the threat of death. Susan Dickson says that he may have enlisted and then deserted at the first opportunity.

    In the compiled service records, there are two jackets for H.F. Bailey, but no firm places are listed and the service appears to have been short in the Confederate army in any case. More research is needed.

    Interestingly, there are a number of letters written to Hume F. Hill of Memphis, TN. These appear to be an uncle of Hume F. Bailey - the brother of his mother, perhaps.
