This suit, brought at the March 1831 court, between Humberton Shipwith, administrator of the estate of Jean Shipwith against not only the Baileys but their neighbors, led to the sale of Bailey's land and Lockett's land. 492 acres was sold at auction on 21 Apr 1831 from Peter Bailey to William Townes for $3.10/acre, a total of $1525.20

But he was guarded whenever a vessel was in port so that he could not escape for quite a length of time. He at length succeeded
in getting away and returning home. The time and place of his death are not known to his descendants.

2332 Henry L. Cooper was born in Delaware, was a Maryland Revolutionary soldier, and moved to North Carolina where he married, 19 Jan 1794, Rebecca Hollis, daughter of John and Mary Hollis. They moved to Tennessee about 1814-15 to Rutherford County. He had three sons and two daughters. Some reports claim that the family lived in the Short Mountain area of Rutherford County.
